1. Introduction
Welcome to Mwanachuo Hub.
These Terms and Conditions govern your access to and use of the Mwanachuo Hub website, mobile applications, communication systems, marketplace features, student-community features and any related services made available by Tanzanite Tech.
In these Terms:
“Mwanachuo Hub,” “we,” “our,” or “us” means Tanzanite Tech, the owner and operator of Mwanachuo Hub.
“Platform” means the Mwanachuo Hub website, mobile application and related services.
“User” or “you” means any person who visits, registers for or uses the Platform.
“Student User” means a student who uses the Platform to browse, purchase, sell, communicate, join study groups or use other student features.
“Seller” means any student, business, local seller, landlord, property representative or other person offering products through the Platform.
“Service Provider” means any person or business offering services through the Platform.
“Buyer” or “Customer” means a User seeking to purchase, hire, book or receive a product, service or accommodation.
“Listing” means any product, service, housing, Lost & Found, event, study-group or other content posted on the Platform.
“User Content” means listings, photographs, videos, reviews, messages, comments, profiles and other material submitted by Users.
By creating an account, posting a Listing, sending a message, making a purchase, booking a service, joining a study group or otherwise using Mwanachuo Hub, you confirm that you have read, understood and agreed to these Terms.
You must not use the Platform if you do not agree to these Terms.
2. About Mwanachuo Hub
Mwanachuo Hub is a student-focused digital platform intended to connect higher-education students with:
Other students;
Student entrepreneurs;
Local sellers;
Service providers;
Hostel and housing providers;
Study groups;
Event organizers; and
Members of nearby campus communities.
The Platform may allow Users to buy and sell products, offer and find services, search for accommodation, participate in study groups, report lost or found property, communicate with other Users and access other student-community features.
Unless Mwanachuo Hub expressly states otherwise in a particular transaction, Mwanachuo Hub provides the technology that connects Users. We do not ordinarily manufacture, own, inspect, store, transport, deliver or supply the products and services listed by independent Users.
3. Acceptance and Electronic Agreement
Your acceptance of these Terms creates an electronic agreement between you and Tanzanite Tech.
You accept these Terms when you:
Create or use a Mwanachuo Hub account;
Select an acceptance box;
Post or respond to a Listing;
Use the messaging system;
Purchase, book, reserve or request something through the Platform; or
Continue using the Platform after being notified of updated Terms.
Electronic confirmations, account records, messages, transaction records and other electronic communications may be retained and used as evidence of your activity on the Platform, subject to applicable law.
4. Eligibility
4.1 General eligibility
You may create an account only if you:
Are at least 18 years old;
Have legal capacity to enter into a binding agreement;
Provide accurate registration information;
Are not legally prohibited from using the Platform; and
Have not previously been permanently removed from Mwanachuo Hub.
4.2 Users under 18
A person under 18 may browse publicly available content where permitted, but must not independently sell, purchase, enter into a housing arrangement, offer a paid service or enter into another binding transaction through Mwanachuo Hub.
Where an under-18 User is allowed to use any feature, the User must have the permission and supervision of a parent or lawful guardian. The parent or guardian will be responsible for the minor’s use of the Platform.
We may request proof of age or parental authority.
4.3 Student status
Some features, offers, groups or benefits may be limited to verified students. We may request a student identification card, institutional email address, admission information or other reasonable evidence of student status.
A User must not falsely claim to be enrolled at, employed by or officially connected with an educational institution.
5. Account Registration and Security
5.1 Account information
You must provide complete, current and accurate information when registering. You must update your information when it changes.
You must not:
Use a false name or impersonate another person;
Create an account for a person without authorization;
Use misleading business or institutional information;
Create multiple accounts to avoid restrictions;
Sell, transfer, rent or share your account;
Register using another person’s student identification; or
Use an account that has been suspended or terminated.
5.2 Account security
You are responsible for:
Keeping your password and login credentials confidential;
Restricting access to your device;
Reviewing activity conducted through your account;
Logging out when using a shared device; and
Notifying us immediately if you suspect unauthorized access.
Activity completed through your account may be treated as authorized by you unless you promptly report unauthorized use.
We will not be responsible for losses caused by your failure to protect your password, mobile device, email account or verification code, except where the loss results directly from our failure to exercise reasonable care.
6. Verification and Trust Features
Mwanachuo Hub may offer identity, student, seller, business, service-provider or housing verification.
Verification may involve checking:
Identification documents;
Student identification;
Phone numbers or email addresses;
Business-registration documents;
Licences or permits;
Property information;
Professional qualifications;
Physical location; or
Other information reasonably required for safety and trust.
A verification badge only means that Mwanachuo Hub completed the verification steps applicable at the time. It does not guarantee that:
The User is honest or trustworthy;
A product is genuine or defect-free;
A service will be completed properly;
A property is safe or legally available;
A Listing remains accurate;
A transaction is risk-free; or
Mwanachuo Hub endorses the User.
Users must still exercise reasonable care and conduct their own checks before entering into a transaction.
Providing false, altered, stolen or misleading documents may result in immediate suspension, permanent termination and referral to the appropriate authorities.
7. Mwanachuo Hub’s Role
Unless expressly stated otherwise, Mwanachuo Hub is not a party to agreements made between Users.
When a Buyer purchases a product from an independent Seller, the sale agreement is between the Buyer and the Seller. When a Customer hires a Service Provider, the service agreement is between the Customer and the Service Provider. When a User rents accommodation, the tenancy or accommodation agreement is between the User and the relevant landlord, agent, hostel operator or property provider.
Mwanachuo Hub does not automatically act as:
A buyer or seller;
A landlord, tenant or property agent;
An employer or recruitment agency;
A transport operator;
A financial institution;
An insurer;
A guarantor;
A university or educational institution;
A professional licensing body; or
A party responsible for a User’s conduct.
We may moderate the Platform, verify certain information, provide payment tools, facilitate communication or assist with complaints. Those activities do not make us the supplier of a User’s product or service.
8. User Responsibilities
Every User agrees to:
Use the Platform lawfully and honestly;
Treat other Users respectfully;
Provide accurate information;
Honour legitimate agreements;
Communicate clearly and promptly;
Protect personal and financial information;
Inspect products or properties where appropriate;
Report suspicious or unlawful activity;
Follow safety guidance published by Mwanachuo Hub; and
Comply with applicable university, hostel, campus and institutional rules.
You are responsible for your decisions, communications, meetings and transactions with other Users.
9. Seller and Service-Provider Obligations
A Seller or Service Provider must provide accurate and sufficient information about themselves and what they offer.
This may include:
Full name or registered business name;
Contact information;
Relevant business status;
Physical or service location;
Complete description of the product or service;
Accurate photographs;
Total price;
Additional charges;
Payment terms;
Delivery or completion time;
Return or cancellation conditions;
Product condition;
Warranty information;
Required licences or qualifications; and
Any limitation, risk or material fact that may affect the Customer’s decision.
A Seller or Service Provider must not:
Post false or misleading claims;
Hide known defects;
Use photographs of a different product;
Advertise unavailable goods to attract Customers;
Manipulate prices after receiving an order;
Misrepresent qualifications or experience;
Sell counterfeit or stolen items;
Post fake reviews;
Pressure Users to make unsafe payments;
Collect unnecessary personal information; or
Refuse statutory rights available to a Customer.
Sellers and Service Providers are responsible for complying with all applicable tax, licensing, consumer-protection, product-safety, employment, transport, housing and business requirements.
10. Listings
10.1 Listing accuracy
Listings must be clear, truthful and placed in the correct category.
The description must disclose all material information, including:
Whether an item is new, used, refurbished or damaged;
Known defects or missing components;
Exact quantity;
Relevant measurements or size;
Authenticity and brand information;
Service scope and exclusions;
Housing conditions and charges;
Location;
Availability; and
Any restrictions applying to the offer.
10.2 Listing photographs
Photographs must accurately represent the listed item, property or service.
You must have permission to use every photograph or image you upload. Stock images may only be used where they do not mislead Users and are clearly identified where necessary.
10.3 Listing approval
Mwanachuo Hub may review, approve, reject, edit the presentation of, restrict or remove a Listing.
Approval does not mean that Mwanachuo Hub has independently confirmed every statement in the Listing.
10.4 Duplicate and misleading Listings
You must not:
Repeatedly post the same Listing;
Use misleading titles or keywords;
Place a Listing in unrelated categories;
Post unavailable products;
Use artificial pricing such as TZS 0 or TZS 1 to manipulate results;
Post one product while describing another;
Redirect Users to unrelated websites; or
Create multiple Listings to unfairly dominate search results.
11. Buyers and Customers
Before agreeing to a transaction, Buyers and Customers should:
Read the entire Listing;
Review the price and additional charges;
Ask relevant questions;
Confirm the identity of the Seller or Service Provider;
Inspect the item where reasonably possible;
Confirm delivery, collection or service arrangements;
Request proof of ownership for high-value goods;
Confirm return or cancellation terms;
Avoid paying into an account held by an unrelated person; and
Keep transaction records and messages.
A Buyer must not:
Place an order without a genuine intention to complete it;
Make false payment claims;
Abuse return or refund procedures;
Threaten a Seller to obtain an improper refund;
Submit fraudulent chargebacks;
Damage a product and falsely claim it arrived damaged; or
Publish a knowingly false review.
12. Transactions Between Users
A Listing is generally an invitation for interested Users to contact the Seller or Service Provider. A binding agreement may arise when the parties clearly agree on the product or service, price and essential conditions.
Mwanachuo Hub may provide order, booking, reservation, acceptance or confirmation tools. The effect of those tools will depend on the information shown during the relevant transaction.
Users are responsible for reviewing transaction information before confirming it. Where the Platform provides an opportunity to correct an input error, the User must review and correct the information before confirmation.
An automated message confirming receipt of an inquiry or order does not necessarily mean that the Seller has accepted the transaction.
13. Prices, Fees and Taxes
13.1 Listing prices
All prices must be displayed in Tanzanian shillings unless another currency is clearly stated.
Sellers must disclose the total price and any additional charges, including:
Delivery charges;
Service-call charges;
Booking fees;
Deposits;
Taxes;
Installation charges;
Materials;
Late fees; or
Other mandatory costs.
A Seller must not advertise one price and demand a higher price after the Buyer has committed, unless the Buyer requests additional goods or services.
13.2 Platform fees
Basic student features may be offered without charge. Mwanachuo Hub may charge businesses, local sellers, Service Providers or Users for selected services, including:
Premium memberships;
Featured Listings;
Sponsored placement;
Advertising;
Verification;
Promotional tools;
Event tickets;
Transaction processing;
Business tools; or
Other optional services.
Applicable fees will be displayed before purchase.
Purchasing a promotion or membership does not guarantee views, inquiries, bookings, sales or income.
13.3 Taxes
Users are responsible for determining and paying taxes, levies, licence fees and other governmental charges arising from their activity.
Mwanachuo Hub may collect, withhold or report information where required by law.
14. Payments
Transactions may be paid through:
Payment tools integrated into Mwanachuo Hub;
Mobile-money services;
Banks;
Cash on delivery;
Direct payment between Users; or
Other approved methods.
Where a third-party payment provider is used, that provider’s terms and charges may apply.
You must not:
Use stolen payment information;
Submit false payment screenshots;
Reverse a valid payment fraudulently;
Use the Platform for money laundering;
Process payment for illegal goods or services; or
Ask a User to transfer money to conceal the true recipient.
Where payment takes place outside Mwanachuo Hub, we may be unable to verify, reverse or recover the payment.
Users should not pay large deposits before confirming the identity, authority and reliability of the other party.
15. Delivery, Collection and Handover
Unless Mwanachuo Hub expressly provides the delivery service, delivery and collection arrangements are made between the Buyer and Seller.
The parties should agree on:
Delivery or collection location;
Expected date and time;
Delivery charge;
Person responsible for transport;
Inspection procedure;
Proof of delivery; and
Responsibility for loss or damage.
Users should meet in safe, public and well-lit places where possible. Students should avoid isolated locations and notify a trusted person before meeting a stranger.
A Buyer should inspect the product before accepting it where reasonably possible.
If Mwanachuo Hub later introduces delivery services, additional delivery terms may apply.
16. Returns, Cancellations and Refunds
16.1 Applicable rights
Sellers and Service Providers must respect all cancellation, return, replacement and refund rights required by Tanzanian law.
A Seller must clearly disclose any additional return policy before a transaction is completed.
A private Seller may offer different voluntary return conditions from a business Seller, but no User may exclude a right that cannot lawfully be excluded.
16.2 Misdescribed, defective or counterfeit products
A Buyer may raise a complaint where an item:
Is materially different from the Listing;
Is counterfeit;
Is unsafe;
Has an undisclosed defect;
Is missing an essential component;
Was not delivered as agreed; or
Cannot reasonably perform the stated purpose.
The Seller must respond promptly and provide an appropriate remedy where legally required.
16.3 Change-of-mind cancellation
Where a statutory cancellation period applies, the Buyer may exercise it in accordance with applicable law. Certain transactions may be excluded, including some accommodation, transport, customized goods, rapidly perishable goods, downloaded products, unsealed software, books and services that began with the Customer’s consent.
The Customer may be responsible for the direct cost of returning eligible goods unless the Seller was at fault or applicable law provides otherwise.
16.4 Refund method
Refunds should ordinarily be issued through the original payment method where reasonably possible.
Mwanachuo Hub is not responsible for issuing a refund owed by an independent Seller unless Mwanachuo Hub collected and continues to hold the relevant funds or expressly agreed to administer the refund.
16.5 Evidence
The parties may be asked to provide:
Listing screenshots;
Payment records;
Messages;
Photographs or videos;
Delivery records;
Inspection reports; or
Other relevant evidence.
Mwanachuo Hub may assist in reviewing evidence but does not guarantee that it can resolve every dispute.
17. Services
Service Providers must describe:
The exact service offered;
Qualifications or experience;
Price or pricing method;
Materials included;
Completion time;
Service location;
Cancellation conditions;
Health or safety risks; and
Any licence legally required.
A Service Provider is an independent person or business and is not an employee of Mwanachuo Hub.
Customers must provide accurate instructions, reasonable access and a safe working environment.
Service Providers must not offer services they are unqualified, unlicensed or physically unable to perform safely.
For transport, repair, beauty, health-related or other higher-risk services, Users must independently verify relevant licences, experience, equipment and safety measures.
18. Hostel, Housing and Roommate Listings
18.1 Platform role
Mwanachuo Hub provides a place for Users to discover hostel, house, apartment, room, short-stay and roommate opportunities.
Unless expressly stated otherwise, Mwanachuo Hub is not the landlord, property owner, tenant, accommodation provider or property agent.
18.2 Housing-provider obligations
A housing provider must accurately disclose:
Property location;
Rent and deposit;
Payment frequency;
Utility costs;
Additional charges;
Accommodation type;
Room-sharing arrangements;
Distance from campus;
Available facilities;
House rules;
Security conditions;
Availability date;
Minimum stay;
Cancellation conditions; and
Any known material problem.
A person posting a property must have authority from the owner, landlord, tenant or lawful manager.
18.3 User checks
Before paying or moving in, Users should:
Visit the property;
Confirm the identity and authority of the person offering it;
Review the written tenancy or accommodation agreement;
Confirm the complete cost;
Inspect locks, water, electricity and sanitation;
Ask about security and access;
Verify the room and facilities shown;
Obtain a receipt for every payment; and
Avoid paying into an unrelated third party’s account.
18.4 Verification limitations
A verified housing badge does not amount to a structural inspection, ownership guarantee, legal opinion, safety certification or promise that the property will remain available.
18.5 Roommate searches
Users participating in roommate searches are responsible for assessing compatibility, safety, financial arrangements and house rules.
Users must not discriminate unlawfully, harass applicants or publish another person’s personal information without consent.
19. Lost & Found
The Lost & Found feature is intended to help Users recover and return property. It must not be used to sell, auction or improperly retain found property.
19.1 Lost-item posts
A User reporting a lost item should:
Provide enough information to help locate it;
Avoid publishing sensitive identifiers;
Avoid sharing full identification, bank-card or document numbers;
State the approximate place and date of loss; and
Keep private details available to verify ownership.
19.2 Found-item posts
A User who finds an item must:
Protect it from loss or damage;
Avoid using, selling or altering it;
Avoid publishing sensitive personal information;
Request reasonable proof of ownership;
Arrange a safe handover; and
Report important official documents or valuable property to the appropriate institution or authority where necessary.
19.3 Claiming an item
A claimant may be asked to identify details that were not publicly disclosed, such as:
Unique markings;
Contents;
Serial number;
Lock-screen information;
Place of purchase; or
Other proof of ownership.
19.4 Rewards and payments
A finder must not demand unreasonable payment, threaten the owner or hold the item for ransom.
A voluntary reward may be offered, but Mwanachuo Hub does not enforce reward promises unless the parties have entered into a legally enforceable agreement.
19.5 Ownership disputes
Mwanachuo Hub does not determine legal ownership of disputed property. Where ownership cannot safely be established, the item should be referred to campus security, police or another appropriate authority.
20. Study Groups and Academic Resources
Study-group features are intended for lawful learning, collaboration and academic support.
Users must not use Mwanachuo Hub to:
Obtain leaked examinations;
Sell examination answers;
Impersonate another student;
Complete graded work dishonestly for another person;
Facilitate plagiarism;
Sell fake academic certificates;
Alter official results;
Access institutional systems without authorization;
Distribute confidential academic material; or
Violate an institution’s academic-integrity rules.
Tutoring, revision support, mentorship, discussion and lawful sharing of original notes are permitted.
A User sharing notes, books or academic resources must have the legal right to distribute them. Uploading or selling copyrighted textbooks, lecturer materials, examination papers or other protected content without authorization is prohibited.
Study groups are generally organized by Users. Unless clearly identified as official, a group is not sponsored, supervised or approved by a university or Mwanachuo Hub.
Group administrators must moderate their groups fairly and must not tolerate harassment, discrimination, intimidation or academic misconduct.
21. Events, Tickets and Volunteering
Mwanachuo Hub may advertise or facilitate student events, workshops, conferences, community projects, competitions and volunteering opportunities.
The event organizer is responsible for:
Event accuracy;
Venue;
Safety;
Programme;
Speakers;
Ticket conditions;
Refunds;
Permissions;
Accessibility; and
Compliance with applicable laws.
Unless Mwanachuo Hub is clearly identified as the event organizer, we are not responsible for an event’s cancellation, postponement, quality, venue, speakers or organizer conduct.
Volunteering opportunities must be lawful, safe and honestly described. Organizers must not disguise paid employment as volunteering, exploit students or collect unnecessary personal information.
Additional event or ticket conditions may apply and will be displayed before registration or purchase.
22. Reviews, Ratings and Comments
Reviews must reflect a genuine experience.
A review must not:
Contain knowingly false information;
Be posted in exchange for an undisclosed benefit;
Be submitted by the Seller about themselves;
Be used to threaten or extort another User;
Contain hate speech or harassment;
Reveal unnecessary personal information;
Include unrelated commercial advertising; or
Manipulate the Platform’s reputation system.
Mwanachuo Hub may remove reviews that violate these Terms. We may also retain a negative review where it represents a genuine experience, even if the reviewed User disagrees with it.
Sellers must not offer refunds, gifts or discounts on the condition that a User removes an honest negative review.
23. Messaging and Communication
Users may communicate through the Platform’s messaging system.
Messages must not be used for:
Harassment;
Threats;
Sexual exploitation;
Fraud;
Spam;
Phishing;
Distribution of malware;
Requests for unlawful payments;
Academic cheating;
Hate speech; or
Unsolicited marketing.
For safety, fraud prevention, complaint investigation and legal compliance, Mwanachuo Hub may use automated tools and authorized personnel to review messages where permitted by law.
Users should keep important transaction communication on the Platform. Moving immediately to an external communication channel may make it more difficult for Mwanachuo Hub to investigate a complaint.
24. Prohibited Products, Services and Activities
The following are prohibited unless Mwanachuo Hub expressly authorizes them and they are lawful:
Stolen goods or property obtained through crime;
Counterfeit products;
Illegal drugs and controlled substances;
Prescription medicines sold without lawful authority;
Weapons, ammunition, explosives and dangerous devices;
Hazardous chemicals or toxic substances;
Pornographic or sexually exploitative material;
Sexual services;
Human trafficking or exploitative labour;
Fake identification documents;
Fake academic certificates or results;
Leaked examinations and examination answers;
Hacking, malware or unauthorized-access services;
Financial scams, pyramid schemes and fraudulent investments;
Gambling services not lawfully authorized;
Wildlife or environmental products sold unlawfully;
Personal data obtained without lawful authority;
Products subject to an active safety recall;
Items prohibited by a university, hostel or campus;
Goods or services that infringe intellectual-property rights;
Discriminatory employment or housing offers;
Dangerous transport services;
Products intended to facilitate violence, self-harm or crime; and
Any other item, service or activity Mwanachuo Hub reasonably considers unlawful, unsafe, deceptive or unsuitable for the student community.
Mwanachuo Hub may publish a separate Restricted Products and Services Policy. That policy will form part of these Terms.
25. Prohibited Conduct
You must not:
Access another User’s account without permission;
Attempt to bypass Platform security;
Scrape or copy Platform data without authorization;
Introduce viruses or harmful code;
Interfere with Platform operation;
Manipulate search results, ratings or reviews;
Use bots to create accounts or Listings;
Collect Users’ personal data for unrelated purposes;
Send spam;
Impersonate Mwanachuo Hub staff;
Make false reports against competitors;
Threaten, bully or discriminate against others;
Use the Platform to organize unlawful conduct;
Encourage off-platform transactions for the purpose of avoiding valid Platform fees;
Abuse promotions, referral rewards or discounts; or
Help another person violate these Terms.
26. Safety
Mwanachuo Hub cannot eliminate all risks associated with dealing with strangers.
Users should:
Use in-app messaging;
Avoid sharing passwords and verification codes;
Meet in public places;
Inspect products before payment;
Tell a trusted person about meetings;
Avoid carrying large amounts of cash;
Confirm property ownership or authority;
Verify high-value products;
Keep receipts;
Report suspicious activity; and
Contact emergency or law-enforcement authorities where immediate danger or criminal conduct is involved.
Mwanachuo Hub support is not an emergency service.
27. Reporting Users and Content
Users may report Listings, profiles, messages, reviews or conduct that appear to violate these Terms.
Reports should be honest and supported by relevant information. Submitting intentionally false or malicious reports is prohibited.
We may investigate a report by:
Reviewing account activity;
Reviewing relevant messages;
Requesting documents;
Contacting affected Users;
Restricting a Listing;
Temporarily holding a feature;
Referring the matter to a payment provider; or
Cooperating with lawful authorities.
For privacy and security reasons, we may not disclose every action taken or every detail of an investigation.
28. Moderation, Suspension and Termination
Mwanachuo Hub may take action where we reasonably believe that a User:
Violated these Terms;
Created a safety risk;
Engaged in fraud;
Posted prohibited content;
Misused personal information;
Failed verification;
Received serious or repeated complaints;
Created legal or regulatory risk;
Interfered with the Platform; or
Acted against the legitimate interests of the Mwanachuo Hub community.
Actions may include:
Warning the User;
Removing content;
Reducing Listing visibility;
Limiting messaging;
Removing a verification badge;
Cancelling a promotion;
Suspending a feature;
Temporarily suspending an account;
Permanently terminating an account;
Preventing creation of replacement accounts; or
Referring the matter to relevant authorities.
Where appropriate and legally permitted, we may provide a reason and an opportunity to appeal. Immediate action may be taken where necessary to protect Users, evidence, the Platform or the public.
Termination does not cancel obligations that arose before termination.
29. User Content and Intellectual Property
29.1 Ownership
You retain ownership of User Content you lawfully create.
You confirm that you own the content or have permission to upload and use it.
29.2 Licence to Mwanachuo Hub
By submitting User Content, you grant Mwanachuo Hub a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, format, translate, display, distribute and use that content for:
Operating the Platform;
Displaying Listings;
Promoting Listings and the Platform;
Improving search and recommendations;
Preventing fraud;
Moderating content;
Providing customer support; and
Enforcing these Terms.
This licence continues for as long as reasonably necessary to operate the Platform, maintain records, resolve disputes and comply with law.
29.3 Mwanachuo Hub property
The Mwanachuo Hub name, branding, logo, software, design, databases, graphics and original content belong to Tanzanite Tech or its licensors.
You may not copy, sell, reverse-engineer, distribute or commercially exploit our intellectual property without written permission.
29.4 Copyright complaints
A rights holder may report allegedly infringing content through the support channel. The report should identify:
The protected work;
The allegedly infringing content;
The reporting person’s contact information;
Evidence of ownership or authority; and
A good-faith statement supporting the complaint.
We may remove content while investigating.
30. Privacy and Personal Information
Mwanachuo Hub processes personal information in accordance with applicable data-protection law and the Mwanachuo Hub Privacy Policy.
Users must not collect, publish, sell or misuse another person’s personal information.
You must not post:
Full identification numbers;
Bank-card details;
Passwords;
Private medical information;
Private academic records;
Another person’s address without permission;
Intimate images;
Confidential messages; or
Other sensitive information that is unnecessary for the Listing.
Sellers, landlords, group administrators and Service Providers who independently collect Users’ personal information are responsible for using it lawfully, securely and only for legitimate purposes.
Mwanachuo Hub may preserve and disclose information where required by law, necessary to protect safety or reasonably needed to investigate fraud or serious violations.
31. Marketing Communications
We may send service-related communications, including:
Security alerts;
Account notices;
Order updates;
Messages;
Policy updates;
Support responses; and
Important Platform announcements.
Where required, promotional messages will be sent based on consent or another lawful basis.
Promotional communications should identify the sender and provide a reasonable way to opt out. Opting out of marketing will not prevent necessary account, security or transaction communications.
Users must not use information obtained through Mwanachuo Hub to send unauthorized marketing messages.
32. Third-Party Services and Links
The Platform may contain links to or integrations with:
Payment providers;
Mapping services;
Delivery companies;
Social-media platforms;
Universities;
Event organizers;
Advertisers; or
Other third parties.
Mwanachuo Hub does not control independent third-party services. Their terms, policies and charges may apply.
A link or integration does not necessarily mean that Mwanachuo Hub endorses the third party.
33. Platform Availability and Changes
We aim to keep Mwanachuo Hub available and secure, but uninterrupted access is not guaranteed.
The Platform may be unavailable due to:
Maintenance;
Security incidents;
Internet or electricity interruptions;
Mobile-network failures;
Third-party service failures;
Software updates;
Technical errors;
Government action; or
Events beyond our reasonable control.
We may add, change, suspend or discontinue a feature. Where a change materially affects a paid feature, we will take reasonable steps to notify affected Users.
34. Search Results, Advertising and Recommendations
Search results may be influenced by factors such as:
Relevance;
Location;
Listing quality;
Recency;
Availability;
User preferences;
Seller performance;
Verification;
Ratings;
Promotional placement; and
Platform-safety considerations.
Sponsored, promoted or featured Listings may receive increased visibility and should be identified where appropriate.
A higher ranking, recommendation or featured position is not an endorsement or guarantee.
35. Disclaimers
To the maximum extent permitted by law:
The Platform is provided on an “as available” basis;
We do not guarantee that every User or Listing is genuine;
We do not guarantee the quality, legality, safety or availability of independently listed products, services or accommodation;
We do not guarantee that a User will complete a transaction;
We do not guarantee sales, income, bookings, employment, housing or academic results;
We do not guarantee that verification will identify every risk;
User-generated content may contain mistakes; and
Safety guidance reduces risk but cannot eliminate it.
Nothing in these Terms excludes any warranty, remedy or consumer right that cannot legally be excluded.
36. Limitation of Liability
To the maximum extent permitted by law, Tanzanite Tech and Mwanachuo Hub will not be liable for indirect, incidental, special or consequential loss arising from:
Transactions between Users;
A Seller’s failure to deliver;
Defective or counterfeit goods;
Service-provider conduct;
Housing disputes;
Lost or stolen property;
User meetings;
Academic misconduct;
Event cancellation;
Third-party payment or delivery services;
Unauthorized account access caused by a User;
Loss of data caused by factors outside our reasonable control; or
Platform interruptions.
Where Mwanachuo Hub is legally liable, our total liability arising from the relevant Platform service will not exceed the greater of:
The amount you paid directly to Mwanachuo Hub for that service during the preceding 12 months; or
TZS 100,000.
The limitation above does not apply where liability cannot legally be limited, including liability arising from fraud, wilful misconduct, gross negligence or any other matter that applicable law prohibits us from excluding.
37. Indemnity
To the extent permitted by law, you agree to compensate Tanzanite Tech, Mwanachuo Hub and their officers, employees and contractors for losses, claims, penalties and reasonable costs arising from:
Your unlawful use of the Platform;
Your breach of these Terms;
Your User Content;
Your infringement of another person’s rights;
Products or services you offer;
Your tax or licensing failures;
Fraud or misrepresentation by you; or
Injury or damage caused by your conduct.
This section does not require you to compensate Mwanachuo Hub for losses caused by Mwanachuo Hub’s own unlawful conduct.
38. Complaints and User Disputes
A User should first attempt to resolve a transaction concern directly and respectfully with the other party.
Where that is unsuccessful, the User may submit a support request with relevant evidence.
Mwanachuo Hub may:
Facilitate communication;
Request additional information;
Suggest a practical resolution;
Restrict the relevant account or Listing;
Cooperate with a payment provider; or
Refer Users to an appropriate authority.
Unless we expressly agree otherwise, Mwanachuo Hub is not an arbitrator and does not issue legally binding judgments between Users.
Users remain free to pursue lawful remedies through consumer authorities, law-enforcement agencies, regulators, mediation or courts.
39. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Republic of Tanzania.
Before commencing formal legal proceedings against Mwanachuo Hub, a User should provide written notice describing the dispute and allow at least 30 days for good-faith resolution, unless urgent relief is required or applicable law provides otherwise.
Any unresolved dispute involving Tanzanite Tech or Mwanachuo Hub will be submitted to a court of competent jurisdiction in Tanzania.
Nothing in this section removes a consumer’s right to submit a complaint to a competent regulatory or consumer-protection authority.
40. Changes to These Terms
We may update these Terms to reflect:
New features;
Changes in law;
Security requirements;
New payment or business models;
Regulatory guidance;
Changes in Platform operations; or
Community-safety needs.
We will publish the updated version and change the “Last updated” date.
Where a change is material, we may notify Users through the Platform, email, push notification or another reasonable method.
Continued use after the effective date of updated Terms constitutes acceptance. Where consent is legally required, we will request it.
41. Closing an Account
You may request account closure through the account settings or support channel.
Closing an account does not automatically:
Cancel a completed transaction;
Remove obligations owed to another User;
Eliminate outstanding fees;
Prevent fraud investigations;
Require immediate deletion of records that must lawfully be retained; or
Remove content that another User has a lawful reason to retain.
We may retain limited information for security, dispute resolution, fraud prevention, financial records and legal compliance.
42. General Provisions
42.1 Entire agreement
These Terms, together with policies expressly incorporated into them, form the agreement between you and Tanzanite Tech regarding Mwanachuo Hub.
42.2 Separate policies
Additional policies may include:
Privacy Policy;
Returns, Refunds and Exchanges Policy;
Restricted Products and Services Policy;
Community Guidelines;
Seller Policy;
Housing Safety Guidelines;
Lost & Found Guidelines;
Payment Policy;
Event Terms; and
Promotion or Membership Terms.
Where a specific policy conflicts with these general Terms, the specific policy will govern the relevant feature, except where these Terms or applicable law provide otherwise.
42.3 Severability
If a provision is found invalid or unenforceable, the remaining provisions will continue to apply. The invalid provision will be interpreted or modified only as much as necessary to make it lawful and enforceable.
42.4 No waiver
Failure to enforce a provision immediately does not waive the right to enforce it later.
42.5 Assignment
You may not transfer your account or rights under these Terms without our written permission.
Tanzanite Tech may transfer its rights and obligations as part of a restructuring, merger, acquisition, financing or transfer of the Mwanachuo Hub business, subject to applicable law.
42.6 No partnership or employment
Use of the Platform does not create an employment, partnership, agency, franchise or joint-venture relationship between you and Tanzanite Tech.
42.7 Force majeure
Neither party will be responsible for delay caused by circumstances beyond reasonable control, including natural disasters, epidemics, war, civil disorder, government restrictions, power failures, network outages or major cyber incidents.
This provision does not excuse payment obligations that arose before the event.
42.8 Language
These Terms may be published in English and Kiswahili. Both versions should be interpreted consistently.
Where an inconsistency cannot reasonably be resolved, the English version will prevail to the extent permitted by law, unless the Platform expressly states otherwise.
